1. Acceptance of Terms

Welcome to SideHustle AI! By accessing or using our mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SideHustle AI ("we," "our," or "us").

2. Eligibility

You must meet the following requirements to use SideHustle AI:

• You must be at least 18 years old
• You must have the legal capacity to enter into a binding agreement
• You must not be prohibited from using the App under applicable laws
• You must provide accurate and truthful information during registration

By using the App, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

SideHustle AI provides:

• AI-Powered Business Plan Generation: Personalized side hustle ideas based on your skills, interests, budget, time, and risk tolerance
• Free Tier: Access to 1 business plan per questionnaire submission
• Premium Tier: Access to all 3 business plans per submission, unlimited questionnaire submissions, and full historical access

4. User Accounts

4.1 Account Creation

To use SideHustle AI, you must create an account by providing:

• A valid email address
• A secure password

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Provide false or misleading information
• Engage in fraudulent activity
• Abuse the service or other users
• Attempt to reverse-engineer or hack the App

5. Subscription and Payment Terms

5.1 Premium Subscription

• Price: $9.99/month (USD)
• Billing Cycle: Monthly, auto-renewing
• Payment: Processed through Apple App Store or Google Play Store

5.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID or Google Play account will be charged within 24 hours prior to the end of the current period.

5.3 Cancellation

You can cancel your subscription at any time:

• iOS: Settings → [your Apple ID name] → Subscriptions → SideHustle AI → Cancel
• Android: Google Play Store → Menu → Subscriptions → SideHustle AI → Cancel

Cancellation takes effect at the end of the current billing period. No refunds for partial months.

5.4 Price Changes

We may change subscription prices with 30 days' notice. If you don't agree to the new price, you can cancel your subscription.

5.5 Refunds

All purchases are final. Refunds are handled by Apple or Google according to their policies:

• iOS: Request a refund from Apple
• Android: Request a refund from Google

In exceptional circumstances (service outage, technical issues), we may offer refunds at our discretion. Contact support@sidehustleai.com.

5.6 Free Trial (If Applicable)

If we offer a free trial:

• You must cancel before the trial ends to avoid being charged
• Trial is limited to one per user (new subscribers only)
• We reserve the right to modify or discontinue trials at any time

6. Acceptable Use Policy

6.1 Permitted Use

You may use SideHustle AI for personal, non-commercial purposes to explore legitimate business opportunities.

6.2 Prohibited Activities

You agree NOT to:

• Use the App for illegal activities or to promote illegal business ideas
• Submit offensive, discriminatory, or harmful content
• Attempt to circumvent payment or access controls
• Share your account credentials with others
• Create multiple accounts to abuse the free tier
• Use automated tools (bots, scrapers) to access the App
• Reverse-engineer, decompile, or extract source code
• Resell or redistribute AI-generated plans as your own service
• Use the service to generate plans for others commercially (business consulting)
• Overload our systems with excessive requests

6.3 Business Ideas Generated

You acknowledge that:

• AI-generated business ideas are not guaranteed to be profitable or viable
• Business plans may contain inaccuracies or outdated information
• You are solely responsible for evaluating and implementing any ideas
• We are not liable for any losses incurred from following AI-generated advice

7. Intellectual Property Rights

7.1 Our Intellectual Property

The App, including its design, code, trademarks, and content, is owned by SideHustle AI and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Use our name or branding without permission
• Create derivative works based on the App

7.2 Your Content

You retain ownership of the information you provide (questionnaire responses). By using the App, you grant us a limited license to:

• Process your questionnaire data to generate business plans
• Store your data on our servers
• Use anonymized, aggregated data for service improvement

7.3 AI-Generated Content

Business plans generated by our AI are provided to you for personal use. You may:

• ✅ Use them to start your own business
• ✅ Share them with advisors/partners for your business
• ✅ Modify and adapt them for your needs

You may NOT:

• ❌ Resell the plans to others
• ❌ Use them as a service to generate plans for clients
• ❌ Claim them as your own original work in publications

8. Disclaimers and Limitations of Liability

8.1 No Professional Advice

8.2 "As-Is" Service

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of AI-generated content

8.3 No Guarantee of Results

We do NOT guarantee that:

• The App will be error-free or uninterrupted
• Business plans will be profitable or successful
• Any specific financial outcomes will be achieved
• AI-generated content is 100% accurate or up-to-date

8.4 Limitation of Liability

To the maximum extent permitted by law, SideHustle AI shall NOT be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or business opportunities
• Financial losses from implementing AI-generated business ideas
• Data loss or corruption
• Service interruptions or downtime

Maximum Liability: Our total liability shall not exceed the amount you paid for the App in the past 12 months (maximum $119.88 for annual premium subscription).

8.5 Third-Party Services

We use third-party services (OpenAI, Supabase, RevenueCat, Apple, Google). We are not responsible for:

• Their service outages or failures
• Changes to their policies or pricing
• Security breaches on their platforms

9. Indemnification

You agree to indemnify, defend, and hold harmless SideHustle AI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any business you start based on AI-generated plans

10. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your data.

11. Modifications to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via:

• In-app notification
• Email to your registered address
• Notice on our website

Continued use of the App after changes constitutes acceptance of the new Terms. If you don't agree, you must stop using the App and cancel your subscription.

12. Termination

12.1 By You

You can terminate your account at any time by:

• Cancelling your subscription (if premium)
• Emailing support@sidehustleai.com to request account deletion

12.2 By Us

We may terminate or suspend your account immediately if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the service

12.3 Effect of Termination

Upon termination:

• Your access to the App will be revoked
• Your data will be deleted per our Privacy Policy
• Active subscriptions will be cancelled (no refunds for partial periods)
• Provisions that should survive termination (liability limitations, indemnification) will remain in effect

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of England, United Kingdom, without regard to conflict of law principles.

13.2 Informal Resolution

If you have a dispute, please contact us first at support@sidehustleai.com. We'll attempt to resolve it informally within 30 days.

13.3 Dispute Resolution

If informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales. Nothing in this section prevents either party from seeking urgent injunctive relief.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SideHustle AI.

14.2 Severability

If any provision is found unenforceable, the remaining provisions will remain in effect.

14.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right.

14.4 Assignment

You may not transfer your account or these Terms. We may assign these Terms to a successor or affiliate.

14.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our control (natural disasters, pandemics, internet outages, etc.).

15. Apple App Store Additional Terms

If you download the App from the Apple App Store:

• Apple is not a party to these Terms
• Apple has no obligation to provide maintenance or support
• Apple is not responsible for product liability claims
• In case of third-party intellectual property claims, Apple is not responsible for investigation or defense
• Apple and its subsidiaries are third-party beneficiaries of these Terms

16. Google Play Store Additional Terms

If you download the App from Google Play Store:

• Google is not a party to these Terms
• Google has no obligation or liability concerning the App
